Terms of Service

These Terms of Service (“Terms”) govern your use of The Florentine Restaurant website, mobile applications, online ordering services, loyalty and rewards programs, promotional offers, SMS/email communications, and related digital services (“Online Services”).

 

By using our Online Services, placing an order, joining a rewards program, or participating in a promotion, you agree to these Terms. If you do not agree, please do not use the Online Services.

   1. Online Ordering

Orders may be placed through our website, mobile app, Toast, or approved third-party ordering and delivery platforms.

 

Menu items, pricing, availability, preparation times, taxes, fees, and promotions may change without notice. We make reasonable efforts to keep menu and pricing information accurate, but errors may occur.

 

Submitting an order does not guarantee item availability. If an item is unavailable, we may contact you to offer a substitute, adjust the order, or issue a refund.

​   2. Payment

Payment may be processed by third-party payment providers, including Toast or other approved platforms. By submitting payment information, you authorize the applicable payment provider to process your payment for the order, applicable taxes, fees, tips, and related charges.

 

The Florentine Restaurant does not knowingly store full credit card numbers on its own systems.

 

   3. Pickup Orders

Estimated pickup times are estimates only. Food preparation times may vary based on kitchen volume, staffing, menu item complexity, and other operational conditions.

 

Customers are responsible for picking up orders promptly. The Florentine Restaurant is not responsible for food quality, temperature, or safety issues resulting from delayed pickup.

 

   4. Delivery Orders

 

Delivery may be provided through third-party delivery providers or delivery partners. Delivery availability, timing, fees, and service areas may vary.

 

Estimated delivery times are not guaranteed. The Florentine Restaurant is not responsible for delays caused by third-party delivery providers, traffic, weather, incorrect delivery information, unavailable recipients, or circumstances outside our control.

 

Customers are responsible for providing accurate delivery addresses, phone numbers, and delivery instructions.

 

   5. Refunds, Cancellations, and Order Issues

Because food orders are prepared to order, cancellations may not be available once preparation has begun.

If there is an issue with your order, contact us as soon as possible. Refunds, credits, replacements, or adjustments may be provided at our discretion based on the circumstances.

Refunds for orders placed through third-party platforms may be subject to that platform’s policies and procedures.

   6. Rewards, Offers, and Promotions

Rewards, app-only offers, discounts, coupons, and promotions may be subject to additional terms, expiration dates, limits, exclusions, and availability.

 

Offers may not be combined unless specifically stated. The Florentine Restaurant may modify, suspend, or discontinue rewards programs, app offers, or promotions at any time.

 

Rewards and promotional credits have no cash value unless required by law.

 

   7. Gift Cards

Gift cards may be subject to additional terms provided at the time of purchase or redemption. Gift cards are not redeemable for cash except where required by law.

Lost, stolen, or damaged gift cards may not be replaced unless required by law and sufficient proof of purchase is provided.

   8. Alcohol Orders

Alcoholic beverages may only be purchased and received by individuals who are at least 21 years of age and legally permitted to purchase alcohol.

Valid government-issued identification may be required at pickup or delivery. Alcohol availability may be limited by law, location, time, order type, or platform restrictions.

The Florentine Restaurant reserves the right to refuse or cancel alcohol orders where required or appropriate.

   9. Allergens and Food Sensitivities

 

Our menu items may contain or come into contact with common allergens, including but not limited to wheat, eggs, milk, soy, peanuts, tree nuts, fish, shellfish, and sesame.

 

While we make reasonable efforts to accommodate requests, we cannot guarantee that any item is allergen-free or free from cross-contact. Customers with allergies or dietary restrictions should contact the restaurant before ordering.

 

   10. Account Responsibility

If you create an account through our Online Services or third-party platforms, you are responsible for maintaining the confidentiality of your login information and for activity under your account.

You agree to provide accurate, current, and complete information when placing orders or joining rewards programs.

   11. Communications

By opting into email, SMS/text, or push notification programs, you agree to receive communications from The Florentine Restaurant. Message frequency may vary. Message and data rates may apply.

 

You may opt out of promotional emails by using the unsubscribe link, opt out of SMS messages by replying STOP, and manage push notifications through your device settings.

 

Transactional or service-related messages may still be sent when necessary for orders, accounts, or customer service.

 

   12. Third-Party Services

Our Online Services may link to or integrate with third-party platforms, including ordering, delivery, payment, loyalty, analytics, advertising, social media, and app-store providers.

Third-party platforms operate under their own terms and privacy policies. The Florentine Restaurant is not responsible for the practices, content, availability, or performance of third-party services.

   13. Acceptable Use

You agree not to misuse the Online Services, interfere with their operation, attempt unauthorized access, submit false information, abuse promotions, or use the services for unlawful purposes.

We may suspend access, cancel orders, revoke rewards, or refuse service if we believe these Terms have been violated.

   14. Intellectual Property

 

The Florentine Restaurant name, logos, designs, menu descriptions, images, website content, app content, and related materials are owned by or licensed to The Florentine Restaurant and may not be used without permission.

 

   15. No Warranties

 

The Online Services are provided on an “as available” and “as is” basis. We do not guarantee that the Online Services will be uninterrupted, error-free, secure, or available at all times.

   16. Limitation of Liability

 

To the maximum extent permitted by law, The Florentine Restaurant is not liable for indirect, incidental, consequential, special, or punitive damages arising from use of the Online Services, orders, delivery services, promotions, or third-party platforms.

   17. Changes to These Terms

 

We may update these Terms periodically. When updates are made, we will revise the Effective Date. Continued use of the Online Services after updates are posted means you accept the revised Terms.
